Terms of Service — Root City Unboxed

These Terms of Service ("Terms") govern your access to and use of the Root City Unboxed mobile app, website, and related services (collectively, "the Service"). By creating an account or otherwise using the Service you agree to be bound by these Terms.

1. Who we are

The Service is operated by City UNBXD UG (haftungsbeschränkt), registered in Germany (Amtsgericht Charlottenburg, HRB 254871 B). Contact: support@cityunbxd.com.

2. Eligibility

  • You must be at least 13 years old (or your local age of digital consent, whichever is higher) to create an account.
  • Users under 16 must have explicit parental permission.
  • You are responsible for ensuring the Service is legal where you use it.

3. Your account

  • You provide accurate information and keep it current.
  • One account per person. Sharing accounts is not allowed.
  • You are responsible for all activity under your account, including unauthorised access caused by weak credentials.
  • We may suspend or terminate accounts that violate these Terms, abuse reports, or engage in cheating (GPS spoofing, automation, multi-accounting, exploitation of bugs).

4. Safety (READ THIS)

The Service guides you to physical locations in real cities. You agree to:

  • Stay aware of your surroundings — traffic, weather, terrain.
  • Not play while driving, cycling, or operating machinery.
  • Follow all local laws and rules (private property, opening hours, protected sites).
  • Respect other players, locals, monuments, and wildlife.

We do not control the physical environment and disclaim liability for any injury, damage, or loss arising from your physical actions while using the Service.

5. Quests, tickets, and virtual goods

  • "Quests" are the playable content. Some quests are free; others require a one-time purchase of a "ticket" (a quest license).
  • Tickets are non-transferable digital licenses tied to your account.
  • "Diamonds" and similar in-app rewards are virtual items with no monetary value outside the Service. They cannot be exchanged for cash.

6. Payments and refunds

  • Payments are processed by Stripe (web) or Apple / Google (mobile), whose terms apply to the transaction itself.
  • All prices include applicable VAT where required.
  • Refund policy: within 14 days of purchase, if you have not started the quest, you can request a refund via support@cityunbxd.com. Once a quest is started, refunds are at our discretion.
  • App Store / Play Store refund requests are handled by Apple / Google.

7. User content

  • "User content" means photos, comments, profile data, and anything else you submit through the Service.
  • You retain ownership of your user content. You grant us a worldwide, royalty-free licence to host, display, and process it solely for operating the Service.
  • You warrant that you have the right to upload what you upload — you do not upload content that infringes IP, depicts non-consenting people, or violates law.
  • We may remove user content that breaches these Terms or applicable law.

8. Acceptable use

You agree not to:

  • Cheat (GPS spoofing, automation, decompilation, exploiting bugs).
  • Harass, threaten, or impersonate other players.
  • Scrape, mirror, or resell any part of the Service.
  • Upload malware, illegal content, or content that infringes IP rights.
  • Bypass security features, rate limits, or admin gates.

Cheating leads to forfeiture of progress and account termination without refund.

9. Our intellectual property

The Service, including but not limited to source code, design, branding, quest content, story text, and curated photography, is owned by us or our licensors. Open-source components are governed by their respective licences, listed in-App under Settings → Open Source Licences.

CC-licensed media (CC-BY, CC-BY-SA, …) carries on-screen attribution and is catalogued in the project's CREDITS.md.

10. Service availability

The Service is provided "as is" and "as available". We aim for high uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law:

  • We disclaim all implied warranties (merchantability, fitness for purpose, non-infringement).
  • Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.
  • We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.

Some jurisdictions do not allow these limitations — in those cases, our liability is limited to the maximum extent permitted.

12. Termination

You may stop using the Service at any time and delete your account from Profile → Settings. We may terminate or suspend your account if you breach these Terms or applicable law. Sections that by their nature should survive termination (IP, liability, dispute resolution) will survive.

13. Changes to these Terms

We may revise these Terms. Material changes are surfaced in-App at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of Germany. Disputes are resolved by the competent courts of Berlin, Germany, without prejudice to your statutory consumer rights to bring proceedings in your country of residence.
